Welcome to secondlifemac.com (the “Site”), operated by Second Life Mac (“SLM,” “we,” “our,” or “us”). These Terms of Use (“Terms”) govern your access to and use of our website. By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

These Terms apply to the use of our website only. Services provided by Second Life Mac, including device buyback, refresh services, and related programs, are governed by separate service agreements between SLM and client organizations.

1. Use of the Website

You may use our Site for lawful purposes only. By using the Site, you agree that you will not:

  • Use the Site in any way that violates applicable federal, state, local, or international law or regulation.
  • Attempt to gain unauthorized access to any portion of the Site, other accounts, computer systems, or networks connected to the Site.
  • Use the Site to transmit or distribute any viruses, malware, or other harmful or disruptive technology.
  • Use any automated system, including robots, spiders, or scrapers, to access the Site for any purpose without our express written permission.
  • Interfere with or disrupt the Site or the servers and networks connected to the Site.
  • Impersonate or attempt to impersonate Second Life Mac, an SLM employee, another user, or any other person or entity.

2. Intellectual Property

All content on the Site, including but not limited to text, graphics, logos, images, photographs, video, audio, data compilations, software, and the overall design and arrangement of the Site (collectively, “Content”), is the property of Second Life Mac or its licensors and is protected by United States and international copyright, trademark, and other intellectual property laws.

The Second Life Mac name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Second Life Mac. You may not use these marks without our prior written permission.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Site and its Content for personal, non-commercial informational purposes. This license does not include the right to reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any Content without our prior written consent.

3. User Submissions

When you submit information through our Site, including through our Refresh Plan request forms, contact forms, white paper download forms, or career application forms, you represent that the information you provide is accurate and that you are authorized to provide it.

By submitting content or information to us through the Site, you grant Second Life Mac a non-exclusive, royalty-free, perpetual, and worldwide license to use, reproduce, modify, and display such content for the purpose of providing and improving our services. This does not apply to personal information, which is governed by our Privacy Policy.

Our Site may contain links to third-party websites, services, or resources that are not owned or controlled by Second Life Mac. We are not responsible for the content, privacy policies, or practices of any third-party websites. The inclusion of any link does not imply endorsement by Second Life Mac.

5. Disclaimers

THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the Site will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not warrant the accuracy, reliability, or completeness of any Content on the Site.

Device valuations, refresh plan estimates, or other financial projections provided through the Site or during initial consultations are preliminary estimates only. Final valuations are determined after physical inspection and diagnostic testing of devices at our facility and are subject to the terms of your service agreement with SLM.

6. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SECOND LIFE MAC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF (OR INABILITY TO USE) THE SITE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO YOUR USE OF THE SITE SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100.00).

7. Indemnification

You agree to indemnify, defend, and hold harmless Second Life Mac, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Site, your violation of these Terms, or your violation of any rights of a third party.

We reserve the right to modify, suspend, or discontinue the Site (or any part thereof) at any time without notice. We also reserve the right to modify these Terms at any time. When we make changes, we will update the “Effective Date” at the top of this page.

Your continued use of the Site after any modifications to these Terms constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.

10. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of law principles. Any legal action or proceeding arising out of or relating to these Terms or your use of the Site shall be brought exclusively in the federal or state courts located in Cook County, Illinois, and you consent to the personal jurisdiction of such courts.

11. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

12. Entire Agreement

These Terms, together with our Privacy Policy and any applicable service agreements, constitute the entire agreement between you and Second Life Mac regarding your use of the Site and supersede all prior agreements and understandings, whether oral or written.
